Magnets

Thanksgiving Day of 2005 marked the first breeze in a whirlwind that has since enveloped the global toy industry. A toddler in Redmond, Wash. died after swallowing eight small magnets that attached in his intestine and caused fatal injuries to the 22-month-old boy.

Since then tens of millions of toys have been recalled worldwide and disappeared from the toy boxes of millions of disappointed children. Osborn Machler played an instrumental role in helping families overcome the horror and anguish of losing a child. At the same time, the firm ensured that many more families were made whole after faulty toys caused grievous injuries, long hospital stays and astronomical medical bills while their children recuperated.

The firm's many successful cases have secured tens of millions of dollars in redress for families in 10 states. At the same time, Osborn Machler fought for the higher goal of forcing the toy industry to apply higher standards to design and manufacture of toys, as well as more stringent oversight of profit-obsessed offshore suppliers.

Osborn Machler built a growing area of expertise with magnetic toys starting with the Redmond case, and has since litigated several cases including Polly Pocket magnetized toy.

Shortly after the Redmond toddler died, Osborn Machler filed several lawsuits against the toy manufacturer. More families began coming forward and within 15 days of filing, the Consumer Product Safety Commission issued a voluntary recall. About six months later, settlements were reached, making it one of the fastest-resolved and most successful cases Osborn Machler ever litigated.
