SEATTLE – (March 20, 2007) – Seattle attorney Sim Osborn announced today that he has settled a lawsuit filed in November 2006 claiming a design flaw in a Mattel toy which allegedly caused injury to a 6-year-old Wyoming boy.
The suit claimed that Devlin Bowman was injured after he ingested small magnets that came loose from a Polly Pocket doll.
According to Osborn, Mattel settled the case for an undisclosed amount of compensation, and without an admission of liability.
“The settlement was fair and equitable, and Mattel acted in good faith throughout the litigation,” Osborn said. “What is more important is that Mattel took immediate action when Mattel learned there could be a problem with its product.”
Through his legal work, Osborn has been instrumental in raising awareness of the dangers posed by small magnets in toys. He represented a number of families whose children were injured after another toy manufacturer’s product was linked to design flaws allowing small magnets to become loose.
